GENERAL TERMS AND CONDITIONS APPLICABLE TO THE TERRITORY OF SPAIN

APPLICABLE REGULATION

Law 7/1998, of April 13, 1998, on general contracting conditions.

Royal Legislative Decree 1/2007, of November 16, 2007, approving the revised text of the General Law for the Defense of Consumers and Consumers and other complementary laws.

Law 34/2002, of July 11, 2002, on information society services and electronic commerce.

Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market (Directive on electronic commerce).

OBJECT

It will be an essential requirement to read and accept the General Conditions of Contract (hereinafter, "GTC"), prior to the purchase of any product through the Web.

For the purposes of this contract, "Consumer" shall mean any natural person acting for purposes other than his trade, business, craft or profession.

Consumers who make purchases on the Web fully accept these GTC and are bound by them, as if they were written at the time of contracting/purchase.

NAT reserves the right to modify the GTC at any time and without notice. The GTC will always be accessible from the website, so that the consumer can consult or print them at any time.

The prices and conditions of sale are for information purposes only and may be modified according to market fluctuations. However, placing an order by filling out the purchase form implies conformity with the price offered and with the general conditions of contract in force at that particular time.

Once the order has been formalized, the purchase will be understood to be perfected by right, with all the legal guarantees that protect the purchasing consumer and, from that moment on, the prices and conditions will be contractual in nature and cannot be modified without the express agreement of both contracting parties.

Spanish will be the language used to formalize the contract. The electronic document in which the contract is formalized will be filed and the consumer will have access to it in his customer area.

NAT reserves the right to deny and/or suspend access to the services provided on the Web for reasons of breach of contractual good faith, breach of applicable law, of these GTC and/or in cases of fraud detected by this company and/or any of its suppliers.

PURCHASING PROCESS

To make a purchase in the Web the process to follow will be the following one:

1. Select the desired product on the Web Site.

2. Click on "Buy". In the upper right corner you can access "My Cart" where the Consumer can see the selected products "View items in your cart".

3. Once the product selection has been completed, it will be necessary to click on "Checkout".

4. Promotional code. In case you have a promotional code, you can insert it in the field "Promotional code" and the final price of the purchase will appear after applying the discount associated with the promotional code.

5. Step 1: In order to complete the purchase process, the Consumer must log in and accept the Privacy Policy. If the Consumer is not registered on the Website, he/she must create an account in the "Create Account" section. It is also possible to log in with your Amazon account.

6. Step 2: If you wish to change the delivery and billing address, you must indicate this in the second step "Addresses". You can select a different billing address than the delivery address by clicking on "Billing address differs from shipping address".

7. Step 3: The identification data of the transport company in charge of managing the delivery of your order will appear.

8. Step 4: Select payment method.

9. View order summary. In the "View details" section you can review the details of your order.

10. Accept these General Terms and Conditions and click on "Pay now and finish".

11. At the end of the purchase process, the customer will automatically receive an e-mail containing the order data, these conditions and the cancellation form.

SHIPPING

The Products sold by NAT are offered within the limits of available stock and, in particular, depending on the availability of NAT Products in store or in stock.

The estimated delivery time is between 24/48 hours. Delivery times are approximate and we cannot guarantee their fulfillment, although we try to ensure that transport companies comply with them whenever possible.

Delivery times will depend on the availability of each product, which is indicated in each and every one of the products offered, as well as the logistical capacity of the transport companies with which we collaborate. In orders that include several items, a single shipment will be made and the estimated delivery time will correspond to the item with the longest delivery time.

The Customer is invited to check, at the time of delivery, the conformity of the Products with his order, as well as any apparent defect, damage or deterioration, and to notify NAT customer service as soon as possible, accompanying the supporting documents (photographs). In case of receiving a product damaged by transport, it is advisable to contact us within the first 24 hours at https://www.nfortec.com/en/contact-us. Also, in order to speed up the return process, we would be grateful if you could send us photographs of the damaged item and its packaging, where the damage can be seen, as well as the serial number of the product.

The Customer is solely responsible in case of non-delivery due to lack of information or wrong information when placing the Order.

GEOGRAPHICAL BOUNDARIES

NAT will only deliver to the Spanish mainland and Balearic Islands. NAT does not sell in the Canary Islands, Ceuta and Melilla.

SHIPPING COSTS

The shipping costs of products to Peninsula are free of charge.

If you place your order in the Balearic Islands, the shipping costs will be 5,25 euros for orders under 50 euros. For orders over 50 euros the shipping costs will be free of charge.

PICK-UP AND DELIVERY CONDITIONS

The Customer shall select the delivery to the postal address designated in the order form, which may not correspond to a post office box or public places, such as public roads, squares, stations, airports or other similar places.

- Home delivery.

The customer must include, as a necessary requirement, the delivery address and billing address. The person in charge of the delivery will contact you by telephone in case the delivery cannot be made. Two delivery attempts will be made and then the order will be returned to the factory or deposited at the nearest collection point, as indicated by the customer.

NAT delivers orders throughout the Peninsula (Spain) and Balearic Islands. No deliveries will be made to the Canary Islands, Ceuta and Melilla. NAT reserves the right not to deliver the products if the complete and correct address is not available, as well as if delivery is requested in the Canary Islands, Ceuta and Melilla.

After the two delivery attempts without delivery, the transport agency will be entitled to deposit your order at the nearest official collection point, which will be made known to the consumer by electronic communication. In this case, the Customer may choose to collect the order at the official collection point or, on the contrary, refuse collection at the delivery point and terminate the contract, in which case the full amount of the order will be paid

In general, the order will be delivered to the address indicated by the consumer. However, in exceptional cases, items which, due to their volume, weight or delivery conditions (ceiling height, elevator, narrow spaces, etc.) cannot be delivered at home by the person in charge of the delivery, may be delivered to the consumer at street level. If the customer does not wish to receive the order at street level, he can refuse it free of charge.

PRICES

The prices of the products are always shown in euros and include VAT, as well as any other applicable tax, being those in force and legally applicable at that time.

The sale prices of the published products do not include the cost of the shipping service. The shipping service is at the expense of the consumer and will be added, whenever applicable, to the total amount of the order, being these identified independently before confirming the purchase.

Within the legal limits, in the event that NAT identifies a manifest error in the price of any of the products published on the website, it will immediately inform the customer and NAT will proceed with the corresponding rectification of the price through the Website and the cancellation of the order. In the event that the customer wishes to make the purchase again, he/she may do so by accessing the publication of the product. In these cases, NAT will not be responsible for the computer error, manual or automated, that causes a substantial alteration in the price of a product sold on the Website that is manifestly lower for a minimally informed consumer than the reasonable market price, to the extent that it is considered an act of bad faith on the part of the consumer.

NAT expressly reserves the right to modify the prices of products on the Website at any time, without prior notice. However, in any case, the rates in force indicated on the Website at the time of placing the corresponding order shall apply. If it is an offer, the price is not reserved for adding it to the cart, the customer must formalize the purchase to be able to enjoy the offer.

All information on prices, products, specifications, promotional campaigns and services may be changed at any time by NAT. Invoices for orders can be downloaded from our website by logging into the User profile through which the order was placed. Within 24 hours after the order has been sent, the invoice will be available in the order history.

PRODUCT PRESALE CONDITIONS

The pre-sale conditions only apply to products that have not yet gone on sale on the market and are expressly designated with the label "Pre-sale" by NAT. The pre-sale does not apply to products that are not expressly mentioned, nor to products that have already gone on sale.

The pre-sale price is fixed and will not be subject to change by NAT.

On the day of the launch of the product indicated on the Website, NAT will process the shipment of the products purchased in pre-sale. The customer may withdraw from the contract within thirty days of delivery in accordance with the provisions of the "Right of Withdrawal" section of these GTC. In case of delay in the launch date due to force majeure or causes not attributable to NAT, customers will be informed by email and will be provided with a new date, and customers will be entitled to terminate the contract if the new date proposed does not suit their interests.

NAT does not process data related to the card number provided by the customer through the payment gateway.

When paying by card, the following information will always be requested: the card number, the expiration date and a validation code, which matches the last three digits of the number printed in italics on the back of your card. We will not contact you by telephone to request additional information, nor should you provide such information by any other means. Financing.

In addition, when the Customer has a Paypal account, he/she may also use the Paypal Pay Later deferred payment method. Payment system subject to the terms and conditions of the holder, PayPal Holdings, Inc.

Amazon Pay

Amazon Pay is a service for Amazon customers, and you can use it during the checkout process by clicking the Amazon Pay button when you checkout. You must have an Amazon Pay account in order to select this payment method. You do not need to log in or sign up for another account. Paypal and Amazon Pay payment methods are managed by the companies that own these payment methods, so NAT declines any responsibility for problems arising from the use of these systems or platforms outside NAT.

FEES, TAXES AND DUTIES

Peninsula and Balearic Islands

The P.V.P. (retail price) of the articles with shipping address to the Peninsula and Balearic Islands includes 21% VAT.

ORDER CANCELLATION

Those order cancellations that involve the reimbursement of the payment to the customer and that are by bank transfer will have a maximum term of thirty (30) days for administrative procedures, although we try to keep the term to no more than seven (7) days.

Before receiving the order, the Customer can request the cancellation of the order through the following form https://www.nfortec.com/en/contact-us. In the event that the order is in the acceptance or preparation phase, NAT will process the automatic refund. In the event that the order is in delivery, a return order will be given to the transport agency and, once the product is received at NAT's facilities, the full refund will be processed in favor of the customer.

RIGHT OF WITHDRAWAL

NAT informs that the Revised Text of the General Law for the Defense of Consumers and Consumers ("TRLCU") provides several options to exercise the right of withdrawal. Among them, it contemplates the possibility of doing so by filling out a form telematically. In order to shorten the time and so that the consumer can make the return in a comfortable way and without delays, from NAT we advise you to make use of this option and fill out the withdrawal form.

In accordance with current legislation, the contract may be cancelled, without the need to justify such a decision and without penalty of any kind, within 30 calendar days of receipt of the goods by the customer. NAT makes available to the consumer the withdrawal form.

The consumer shall only be liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish their nature, characteristics or functioning.

The right of withdrawal shall not apply to contracts relating to:

a. The provision of services, once the service has been fully performed, and if the contract imposes on the consumer or consumer an obligation to pay, when performance has begun, with the prior express consent of the consumer or consumer and with the knowledge on his part that, once the entrepreneur has fully performed the contract, he will have lost his right of withdrawal.

b. The supply of goods or the provision of services whose price depends on fluctuations in the financial market that the entrepreneur cannot control and that may occur during the withdrawal period.

c. The supply of goods made to the consumer's specifications or clearly personalized.

d. The supply of goods that may deteriorate or expire rapidly.

e. The supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery.

f. The supply of goods that after their delivery and taking into account their nature have been inseparably mixed with other goods.

g. The supply of alcoholic beverages whose price has been agreed upon at the time of entering into the sales contract and which cannot be delivered within 30 days, and whose actual value depends on market fluctuations beyond the entrepreneur's control.

h. Contracts in which the consumer and consumer has specifically requested the trader to visit him for urgent repair or maintenance operations; if, during such a visit, the trader provides services in addition to those specifically requested by the consumer or supplies goods other than the spare parts necessarily used to carry out the maintenance or repair operations, the right of withdrawal should apply to such additional services or goods.

i. The supply of sealed sound or video recordings or sealed computer programs that have been unsealed by the consumer and consumer after delivery.

j. The supply of daily newspapers, periodicals or magazines, with the exception of subscription contracts for the supply of such publications.

k. Contracts entered into through public auctions.

l. The provision of lodging services for purposes other than housing, transportation of goods, car rental, food or services related to leisure activities, if the contracts provide for a specific date or period of performance.

m. The supply of digital content that is not provided on a tangible medium when performance has begun and, if the contract imposes a payment obligation on the consumer or consumer, when the following conditions are met:

1. The consumer has given his prior consent to start the performance during the period of the right of withdrawal.

2. The consumer has expressed his knowledge that, as a consequence, he loses his right of withdrawal; and.

3. The employer has provided a confirmation pursuant to Article 98.7 or Article 99.2 TRLCU.

Once we receive the product(s), we will refund you according to the payment method you used:

If you paid by credit card, we will credit your account within 48 to 72 hours.

If you paid by financing, we will proceed to make a total or partial cancellation of the amount financed, depending on the case.

Amazon Pay and Paypal. NAT will give return order through the chosen payment system.

In case of withdrawal, NAT will refund all payments made for your order, including delivery costs (with the exception of the additional costs resulting from your choice of a delivery method other than the least expensive ordinary delivery method offered by us) and the limits set out in this paragraph. The refund of the purchase price will be made once the condition of the goods has been checked and, in any case, within a maximum of fourteen (14) calendar days from the actual receipt of the withdrawal request. In the event that the Customer returns the item through a carrier of his choice, the period of fourteen (14) days will begin to run from the time NAT has actual knowledge of the shipment of the goods or, failing that, from the receipt of the item.

For orders delivered in the Balearic Islands, the consumer and user will bear the direct costs of return (transport costs) of the products subject to the right of withdrawal. NAT assumes the return costs only for products delivered in Spanish peninsular territory.

NAT will check in its warehouse the suitability of the returned product, reserving the right not to make the refund in case of detecting that the product does not meet the requirements determined in these GTC.

NAT recommends its Users to keep the original packaging of the products for at least 30 days from the receipt of the order in order to make use of it in the event of withdrawal.

*Return of products with gift or promotion: it will be mandatory the complete return (complete pack or item + gift) in order to proceed with the refund. In the case of products that include game download codes, it will be a requirement not to have downloaded it in order to proceed to the full refund. In the event that the game has been downloaded, the amount of the game will be deducted from the total amount to be refunded.

Digital content: The refund for withdrawal is only applicable if the product code has not yet been discovered or downloaded.

In order to avoid any kind of damage in the shipment, all merchandise must be returned in its original condition, in perfect condition and protected, avoiding stickers, seals or adhesive tapes directly on the surface or packaging of the item.

WARRANTIES

In accordance with current regulations, all new products sold on the Website - purchased on or after January 1, 2022 - are warranted against manufacturing defects for a period of three (3) years from the date of delivery.

Second-hand products labeled as "Refurbished" have a legal warranty period of one year.

In case of defective product, NAT will proceed, as appropriate, to repair, replacement, price reduction or termination of the contract, these steps being free of charge for the consumer. The shipment of the defective product for repair or replacement will be free of charge for the customer as long as the defect is covered by the warranty.

The warranty does not cover defects caused by incorrect use of the product and/or handling of the product other than what is necessary to establish its nature, characteristics or operation. In such cases, the consumer shall be responsible for its repair. They are therefore excluded from the warranty:

Defects and deterioration caused by external events, accidents, mainly electrical accidents, wear and tear and use not in accordance with the product's instructions or those given by NAT.

Products modified or repaired by the customer or any other person not authorized by NAT, as well as products that are the subject of a specific support contract.

Incorrect software/hardware configuration, by the customer, of a piece of equipment, component or peripheral.

Incorrect software/hardware configuration or equipment failure caused by a component not supplied by NAT and incorporated by the customer.

Infection of computer viruses, by the customer, in equipment, hard disks or diskettes of drivers or additional software.

In the absence of proof to the contrary, products shall be deemed to be in conformity when they comply with the requirements established in Article 115 of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.

In the event that the product is exempt from warranty for the legally established reasons, NAT will inform the consumer about the possibility of requesting a quotation. After issuing the estimate - previously requested by the customer -, in the event that the customer rejects it, the costs of processing will be charged to the customer in accordance with Royal Decree 58/1988, of 29 January, on the protection of consumer rights in the service of repair of household appliances.

PRIVATE COPYING LEVY SYSTEM

Pursuant to Royal Decree-Law 12/2017 12/2017, of July 3, amending the revised text of the Intellectual Property Law, approved by Royal Legislative Decree 1/1996, of April 12, regarding the fair compensation system for private copying, NEW ALTERNATIVE TECHNOLOGIES, S.L.U. will have to charge, in appropriate cases, a royalty for the sale of those products or non-typographic devices, offered for sale on the Web that, intended exclusively for private use, not professional or business, reproduce works (books or similar publications, phonograms and videograms) owned by third parties (publishers, producers of phonograms and videograms, performers...).

Notwithstanding the foregoing, it is reported the existence of a system of exemption and reimbursement of the payment of these compensations which is regulated in the new art. 25, point 7 and 8 of the Intellectual Property Law, modified by the referred Royal Decree-Law 12/2017 which regulates the mode and requirements to justify the right to reimbursement for those individuals and legal entities exempted by law and/or those who without being exempted have accredited to destine the product acquired to an exclusively professional use or to its export or intra-Community delivery.

In this sense, those companies, professionals, freelancers and public bodies exempted in the sense indicated, must obligatorily accredit NAT, by means of the certificates established in the Royal Decree-Law, that they are within the fee exemption assumptions in order to be able to legally apply them.

Applicable law and jurisdiction

These General Terms and Conditions are governed by the common Spanish legislation. The parties submit, for the resolution of any conflicts that may arise, to the courts and tribunals of the Consumer's domicile.
